Charleston Wang served as Vice President and General Counsel to Environmental Enterprises
Incorporated, Cincinnati, Ohio.  In that capacity, he gained broad and practical experience in
general corporate matters, with emphasis on the day-to-day management of legal issues from
within an U. S. business organization, including employment law, regulatory and administrative
compliance in a highly regulated industry (treatment, storage, disposal, and transportation of
hazardous waste, environmental assessment, audits, remediation and emergency response), risk
management, and management of litigation.  For 8 years prior, Mr Wang was engaged in the
Federal government, within the U. S. Occupational Safety & Health Administration (OSHA) and
the National Institute for Occupational Safety and Health (NIOSH).

     FOR INTERNATIONAL INVESTORS

In recognition of changing international financial and economic conditions, since October 1,
1991, the United States Immigration and Naturalization Act (INA) had been amended to allow
business people who invest in the United States to obtain permanent residence status (the Green
Card) and eventual United States Citizenship.  Under this immigration statute, permanent
residence can be granted to a qualified investor, his or her spouse and unmarried children
through the employment-based fifth preference without going through the tedious, competitive,
and uncertain process of labor certification. WANGLAW is available to assist business owners
and investors who are planning to set-up and conduct business inside the United States, and who
happen to be also interested in obtaining permanent residence in the United States. WANGLAW
will provide legal counsel provide legal counsel starting with the I-526, continuing with the
creation of the new commercial enterprise and its operation as a going concern, through the
issuance of lawful permanent residence status to the investor and upon election, the application
for and conferment of United States Citizenship.   This vital program has sunset since September
15, 2015, but was temporarily renewed.   Under a new rule published by the U.S. Department of
Homeland Security, several changes to the EB-5 Immigrant Investor Program will go into effect
on Nov. 21, 2019.  It is in need of long-term renewal by the United States Congress.

                                          FOR ALL IMMIGRANTS & TRAVELERS

WANGLAW will provide counsel and assistance in immigration and naturalization law
matters and procedings, including family sponsored and employment based immigration (legal
permanent resident LPR or Green Card status), temporary visas, temporary workers, asylum and
refugee protection, agency adjudication interviews, administrative hearings which include
detention, deportation, and removal proceedings (motion for bond, motion for stay, application
for Cancellation of Removal, motion to reopen, and other relief from deportation),
administrative appeals with the Administrative Appeal Office (AAO), and before the Board of
Immigration Appeals (BIA), and defense of criminal charges of violation of immigration law
(immigration crimes), and judicial review in all levels of the Federal court system. WANGLAW
will represent clients on appeal before the Board of Immigration Appeals.  Mr. Wang is admitted
to the bar of the Supreme Court of the United States of America.  

WANGLAW will appear on behalf of individuals in the federal immigration agencies, the
U. S. immigration courts, and during proceedings in
habeas corpus, mandamus and coram nobis
before United States District Courts.  Representation in the federal judiciary has taken on a new
and vital importance in light of the shifts towards a more rigorous enforcement of immigrations
law since the beginning of 2017.

ALERT: PUBLIC CHARGE RULE BEING ENFORCED

ON February 27, 2020, the Supreme Court of the United States by a 5-4 vote gave the green light
to the Trump Administration to implement its "Public Charge" rule while challenges are argued
and decided in the lower courts.  The "Public Charge" rule is designed to narrow the issuance of
Green Cards or immigrant visas to permanently enter and reside in the United States.  

To comply with the "Public Charge" rule, all persons seeking Legal Permanent Residency (the
Green Card) must fill out and submit form I-944.  The I-944, also called a Declaration of
Self-Sufficiency, is a 18 page questionnaire that seeks detailed disclosure of a person's financial
status and history including indications of poverty and prior dependence on public financial
assistance.   The I-944 will be examined by government officials such as USCIS adjudication
officers and State Department consular officers, all of whom are authorized to deny an
application for a visa using information provided in the I-944.  There has been instances where
submission of a co-sponsor's Affidavit of Support bas not been accepted as evidence of financial
self-sufficiency.

The recent implementation of the I-944 leaves open the question of whether the Public Charge
Rule will be expanded to aliens seeking to obtain, renew, or change the status of temporary visa.  
Legal Permanent Residents who are seeking to remove the 2 year condition on their Green Cards
or are returning to the United States from abroad may also be subject to the Public Charge Rule.
The rule itself has been challenged on fundamental grounds and in the days and weeks to come,
the way this rule is enforced surely will be challenged as well.  It is well established constitutional
law that "even if the law is impartial on its face, if it is applied and administered by public
authority with an evil eye and an unequal hand, so as practically to make unjust and illegal
discriminations between persons in similar circumstances, material to their rights, the denial of
equal justice is still within the prohibition of the Constitution."

Because of the complexity of the I-944 on its face, and the severity of its current enforcement, all
persons who must submit this form are well advised to seek assistance from a legal professional
competent in administrative immigration law and litigation of fundamental questions in federal
courts.  Uncertainty and confusion are expected to continue until the courts cases are definitely
resolved.  The use of caution and diligence in filling the I-944 are recommended.
